The no-permit advantage (mostly).
The Victoria Building Regulations exempt single-storey outbuildings under 25m² floor area, 3.6m maximum height, and not used for habitable purposes from needing a planning permit in most residential zones. That means a properly-sized garden studio can go from contract to keys in 6–10 weeks with no council delay — faster than almost any other build category.
Catches: it must be a genuine non-habitable space (no permanent sleeping, no full kitchen), the 25m² rule excludes Mornington Peninsula Shire’s Design and Development Overlays in some cases, and any plumbing or drainage still needs a building permit (not the same as a planning permit).
What we build in this category.
- Home office 12–18m² (no plumbing): Wired for high-speed data, separate-meter electrical option, double-glazed for thermal performance, acoustic ceiling for video calls. $25K–$45K all-in.
- Studio with bathroom 18–25m²: Adds toilet + basin + shower (plumbed via main house sewer). Crosses into building-permit territory. $50K–$85K.
- Teen retreat 15–25m²: Single bed alcove, study desk, small wet bar (sink + bar fridge only, no full kitchen), sound isolation. $40K–$70K.
- Hobby workshop / garage studio: Higher ceiling option (still under 3.6m), reinforced floor for equipment, three-phase power if needed. $30K–$60K.
- Art / podcast studio: North-light glazing for artists, acoustic treatment + isolation for podcast/music. $45K–$95K.
When a garden studio is NOT the right answer.
- You want it as accommodation for an ageing parent — need a 1-bedroom granny flat instead
- You want to rent it out — need a 1-bedroom granny flat with planning permit
- You’re in an overlay (HO heritage, DDO design controls, BMO bushfire) — check before relying on the no-permit pathway
- Block is <400m² — outdoor area requirements still apply even for non-habitable structures
Common Peninsula garden studio specs.
- Slab: 100mm reinforced (or steel-bearer for sloped sites)
- Frame: pine 90mm or steel cee-section for clear-span
- Cladding: Hardies Linea, Colorbond, or natural timber to suit garden setting
- Roof: Colorbond or membrane flat-pitch for height-restricted sites
- Insulation: R2.5 walls, R5.0 ceiling (above the non-habitable minimum — comfort matters)
- Electrical: 8-12 outlets, dedicated 20A circuit, optional data conduit
- Climate: split-system reverse-cycle (most common) or just ceiling fan + insulation for milder use
